1. About Duber
Duber ("we", "us", "our") is a technology platform operated by Duber Technologies Private Limited, registered in India. Duber provides an online marketplace that connects customers who require driver services with independent, verified drivers ("Driver Partners"). Duber is a technology intermediary, not a transportation company. We do not own or operate any vehicles and do not employ drivers.
The platform is available as a mobile application on Android and iOS and via the website at duber.in.
2. Eligibility
- You must be at least 18 years of age to register or use the Service.
- You must have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.
- If you are registering as a Driver Partner, you must hold a valid Motor Vehicle driving licence issued under the Motor Vehicles Act, 1988, applicable to the class of vehicle you intend to drive.
- Use of the Service is void where prohibited by applicable law.
3. Account Registration & Security
You must create an account to use the Service. You agree to:
- Provide accurate, current, and complete information during registration and keep it updated.
- Keep your login credentials confidential and not share them with any third party.
- Accept full responsibility for all activities occurring under your account.
- Immediately notify us at admin@duber.in of any unauthorised access or security breach.
We reserve the right to suspend or terminate accounts that contain false information or are found to be misused.
4. Services Offered
4.1 Driver-on-Demand
Customers can book a verified Driver Partner to drive their own private vehicle for trips including daily commutes, outstation journeys, airport transfers, and events.
4.2 Cab Service
Customers can book a Driver Partner along with a commercial vehicle for point-to-point transportation.
4.3 Service Availability
Service availability is subject to Driver Partner availability in your area. Duber does not guarantee availability at any given time. We may modify, suspend, or discontinue any part of the Service with or without notice.
5. Bookings & Cancellations
5.1 Booking Confirmation
A booking is confirmed only when you receive an in-app confirmation and a Driver Partner accepts the request. Duber does not guarantee the acceptance of any booking request.
5.2 Customer Cancellation
Customers may cancel a booking before the Driver Partner arrives. Cancellations made after the driver has been assigned or after a specified grace period may attract a cancellation fee as displayed in the app at the time of booking.
5.3 Driver Cancellation
Driver Partners may cancel a booking in exceptional circumstances (e.g., vehicle breakdown, personal emergency). In such cases, Duber will attempt to arrange an alternative Driver Partner. Duber is not liable for any loss or inconvenience caused by driver cancellations.
5.4 No-Show
If a customer is unreachable or does not appear within a reasonable wait time after the driver has arrived at the pickup location, the booking may be treated as cancelled and a no-show fee may apply.
6. Fares & Payments
6.1 Fare Calculation
Fares are calculated based on distance, duration, vehicle type, trip type, and applicable surcharges shown in the app before booking confirmation. The fare displayed is an estimate; final fare may vary due to route changes, waiting time, or overtime.
6.2 Payment Methods
Payments may be made via cash, UPI, debit/credit card, or other methods available in the app. All electronic payments are processed through third-party payment gateways. Duber does not store card or bank account details.
6.3 Taxes
All applicable taxes including GST shall be borne by the customer and are included in the final fare unless stated otherwise.
6.4 Refunds
Refund requests for disputed charges must be raised within 7 days of the trip. Duber will review and process eligible refunds within 7–14 business days to the original payment method.
6.5 Surge Pricing
During periods of high demand, fares may be higher than standard rates. Surge pricing, when applicable, will be disclosed before booking confirmation.
7. Driver Partner Terms
7.1 Independent Contractor Status
Driver Partners are independent contractors, not employees, agents, or partners of Duber. Duber does not control the means or manner by which Driver Partners provide transportation services. Driver Partners are solely responsible for their conduct, safety, and compliance with applicable laws.
7.2 Eligibility & Documentation
To register as a Driver Partner, you must provide and maintain valid copies of:
- Government-issued photo identity proof (Aadhaar Card)
- Valid Driving Licence (appropriate class for the vehicle)
- PAN Card
- Vehicle Registration Certificate (where applicable)
- Vehicle Insurance (where applicable)
7.3 Background Verification
All Driver Partners are subject to police verification and document verification before being approved. Duber reserves the right to reject any applicant or revoke approval at any time if verification fails or conduct is found to be unsatisfactory.
7.4 Conduct
Driver Partners must at all times:
- Comply with all applicable traffic laws and regulations under the Motor Vehicles Act, 1988.
- Treat customers with respect and professionalism.
- Not drive under the influence of alcohol or any controlled substance.
- Not engage in any form of harassment, discrimination, or abuse.
- Maintain the vehicle in a safe and roadworthy condition.
7.5 Platform Fees
Driver Partners agree to pay applicable platform service fees as communicated by Duber. Unpaid fees may result in suspension from the platform.
8. Location & Data Usage
The Service requires access to your device's GPS location to function. Specifically:
- Customers: Location is used to identify your position for pickup and to show nearby drivers on the map.
- Driver Partners: Location is continuously tracked while online and shared with the matched customer to enable real-time tracking during a booking.
- Location data is transmitted to our servers and may be retained as described in our Privacy Policy.
- You may revoke location permission at any time via your device settings, but doing so will prevent the Service from functioning correctly.
By using the Service, you explicitly consent to the collection, processing, and sharing of your location data for the purposes described above, in accordance with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023.
9. Privacy & Personal Data
Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, store, and disclose personal data. By using the Service, you consent to such collection and use. We collect:
- Identity information (name, phone number)
- Location data (GPS coordinates during active sessions)
- Payment information (processed via third-party gateways; we do not store raw card data)
- Device and usage data (device model, OS version, app version, usage logs)
- Communication data (in-app messages, support interactions)
We do not sell your personal data to third parties. Data may be shared with Driver Partners to facilitate bookings and with payment processors to complete transactions.
10. Camera & Media Access
Driver Partners are required to capture pre-trip photographs of the vehicle (odometer, exterior). The app requests camera and photo library access for this purpose. Customers may also be asked to upload identity documents during onboarding. Images uploaded are stored securely and used solely for the stated purpose.
11. Insurance & Liability for Trips
Duber does not provide insurance coverage for trips. It is the sole responsibility of:
- The vehicle owner to maintain valid third-party and comprehensive vehicle insurance.
- The Driver Partner to hold a valid driving licence and comply with all conditions of the vehicle's insurance policy.
Duber explicitly disclaims all liability for accidents, injuries, property damage, theft, or any other incident occurring during or in connection with a trip. Customers acknowledge that they engage Driver Partners at their own risk.
An optional trip insurance product may be offered in-app through a licensed third-party insurer. Purchase of such insurance is entirely voluntary and governed by the insurer's own terms.
12. Prohibited Uses
You agree not to use the Service to:
- Transport illegal goods, controlled substances, or weapons.
- Engage in any unlawful activity under Indian law or applicable local law.
- Harass, threaten, or harm any driver, customer, or Duber employee.
- Provide false information, create fake accounts, or impersonate any person.
- Reverse-engineer, scrape, or attempt to gain unauthorised access to the platform or its data.
- Use the platform for any commercial resale or sub-licensing of services without written consent.
- Solicit Driver Partners to bypass the platform or transact outside the app.
- Attempt to manipulate ratings, reviews, or the booking system.
Violation of this section may result in immediate account termination and may be reported to law enforcement authorities.
13. Ratings & Reviews
Both customers and Driver Partners may rate each other after a completed trip. Ratings must be honest and based on the actual experience. Fake, coerced, or retaliatory ratings are prohibited. Duber reserves the right to remove ratings that violate these guidelines. Persistent low ratings may result in account suspension.
14. Intellectual Property
All content, branding, software, and technology on the Duber platform — including the name "Duber", logo, app design, source code, and documentation — are the exclusive property of Duber Technologies Private Limited and are protected under applicable Indian and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the app solely for personal use as permitted by these Terms. No other rights are granted.
15. Limitation of Liability
To the maximum extent permitted by applicable law:
- Duber's total aggregate liability to you for any claim arising out of or related to the Service shall not exceed the total amount paid by you to Duber in the three (3) months preceding the event giving rise to the claim.
- Duber shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profit, goodwill, data, or business opportunities.
- Duber is not liable for the acts, omissions, or conduct of Driver Partners, other customers, or third parties.
- Duber is not liable for service interruptions caused by force majeure events including but not limited to natural disasters, government actions, network failures, or pandemics.
16. Indemnification
You agree to defend, indemnify, and hold harmless Duber, its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your breach of these Terms; (c) your violation of any applicable law; or (d) any claim by a third party arising from your actions or omissions in connection with the Service.
17. Termination
Duber may suspend or terminate your account, with or without notice, for:
- Breach of these Terms or any applicable law.
- Conduct deemed harmful to users, Driver Partners, or the platform.
- Failure to pay applicable fees.
- Fraudulent activity or misrepresentation.
- Any reason at Duber's sole discretion, subject to applicable consumer protection laws.
You may delete your account at any time via the app or by contacting admin@duber.in. Deletion requests will be processed within 30 days. Certain data may be retained as required by law (e.g., financial records for taxation purposes).
18. Grievance Redressal
In accordance with the Information Technology Act, 2000, and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the following Grievance Officer has been appointed:

Response Time: Complaints will be acknowledged within 24 hours and resolved within 15 days of receipt.
19. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved as follows:
- Informal Resolution: Parties shall first attempt to resolve the dispute informally by contacting admin@duber.in. A 30-day good-faith negotiation period applies.
- Arbitration: If informal resolution fails, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English, seated in Dehradun, Uttarakhand.
- Jurisdiction: For matters not subject to arbitration, the courts of Dehradun, Uttarakhand shall have exclusive jurisdiction.
20. Changes to These Terms
Duber reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. For material changes, we will notify you via in-app notification or email at least 14 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
21. App Store Specific Terms
21.1 Apple App Store
If you downloaded this app from the Apple App Store, you acknowledge that: (a) these Terms are between you and Duber only, not Apple Inc.; (b) Apple has no obligation to provide support or maintenance for the app; (c) Apple is not responsible for any claims relating to the app; (d) Apple is a third-party beneficiary of these Terms and may enforce them against you. Your use of the app must also comply with the Apple App Store Terms of Service.
21.2 Google Play Store
If you downloaded this app from Google Play, your use is also subject to Google Play's Terms of Service. In the event of a conflict between Google Play's terms and these Terms, these Terms shall govern to the extent permitted by law.
22. Miscellaneous
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Duber regarding the Service.
- Severability: If any provision is found to be unenforceable, the remaining provisions shall continue in full force and effect.
- No Waiver: Failure to enforce any right under these Terms shall not constitute a waiver of that right.
- Assignment: You may not assign your rights under these Terms without prior written consent. Duber may assign its rights freely.
- Language: These Terms are in English. In the event of any conflict with a translated version, the English version prevails.
